1. Acceptance of Terms

By accessing or using birthday.tools ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

2. Description of Service

birthday.tools is an event planning platform that allows users to create events, manage guest lists, wishlists, polls, budgets, timelines, seating plans, and share invitations. The Service is available in free and premium tiers.

3. User Accounts

• You must provide accurate information when creating an account
• You are responsible for maintaining the security of your account
• You may sign in using email/password, Google, or Apple ID
• One person per account — shared accounts are not permitted
• You must be at least 16 years old to use the Service

4. Free and Premium Plans

The Service offers a free tier with usage limits and a premium tier with extended features. Limits include the number of events, guests, photos, wishlist items, and other features as described in the platform. We reserve the right to modify plan limits with reasonable notice.

5. User Content

• You retain ownership of all content you upload (photos, text, event data)
• You grant us a license to store, display, and transmit your content as necessary to provide the Service
• You must not upload content that is illegal, offensive, or infringes on others' rights
• We may remove content that violates these terms
• Uploaded images are limited to JPG and PNG formats, maximum 15MB

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to other users' accounts or data
• Send spam or unsolicited messages through the platform
• Upload malicious files or code
• Scrape, crawl, or automatically extract data from the Service
• Resell or redistribute the Service without permission

7. Event Sharing and Guest Data

• When you create an event and share it, guests can view event details, RSVP, and interact with wishlists/polls
• As an event organizer, you are responsible for informing your guests about data collection
• Guest data (name, email, RSVP status) is only accessible to the event organizer and co-hosts
• Budget data is private — only visible to the organizer and co-hosts

8. Limitation of Liability

The Service is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability is limited to the amount you paid for premium services in the 12 months preceding the claim.

9. Termination

You may delete your account at any time. We may suspend or terminate your account if you violate these terms. Upon termination, your data will be deleted in accordance with our Privacy Policy.

10. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance. We will notify users of material changes via email.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the European Union. Any disputes shall be resolved in the competent courts of the EU member state where the Service operator is established.
